NO PARTY CAN WITHDRAW CRIMINAL CASE FROM COURT

Legal Expert, Lawyer Kwame Boateng says no individual or group of people can withdraw a criminal case from court.
He explains that first degree crimes such as Sodomy, Armed Robbery, and Murder cannot be withdrawn from court even if the complainant decides not to take interest in the case.
Lawyer Kwame Boateng was reacting to the arrest of Lance Corporal Raymond Ametepe a Prisons Officer at the Akuse Police Station, who allegedly sodomized three boys.
The matter is now in court, but the parents of the boys who are on record as complainants are said to be putting pressure on the police to withdraw the case from court.
But Lawyer Kwame Boateng says criminal matters cannot be withdrawn from court by an individual, because it is a matter between the state and the accused.

Lawyer Kwame Boateng says even if the victims and complainants are no more interested in the court case, the court has a power to summon them as witnesses to assist in investigations.
He explains that one will be committing contempt of court if he/she refuses to testify in court.
